My Stamps: General Terms and Conditions for Delivery to Consumers
1 Scope of Application and Validity
These terms and conditions apply to the Åland Post as seller of My Stamps to consumers anywhere in the world. In these terms and conditions, consumer is defined as a physical person, who orders My Stamps primarily for a use other than business and trade.
These terms and conditions apply if no other written agreement has been made between the consumer and the Åland Post. By placing an order, the consumer accepts these terms and conditions.
These terms and conditions came into effect 12 June 2010 and are valid until further notice.
2 Drawing-up and Transfer of Agreement
An order agreement for My Stamps is formed when the Åland Post has accepted the consumer’s order. The Åland Post has the right to assign the agreement in full or in part, without the consumer’s consent, to a third party, which then takes over the services noted in the agreement. The Åland Post notifies the consumer of the transfer of agreement in advance. The Åland Post also has the right to assign claims based on the agreement to a third party.
3 Policies and Procedures
The Åland Post reserves the right to change the retail policies without notifying the consumer by publishing the changed terms and conditions on the Internet address: www.posten.ax. Before placing an order, the consumer must always read and accept the terms and conditions. If the consumer does not accept all parts of the terms and conditions or the consumer has no legal right or authorization to accept these terms and conditions, the consumer may not use the ordering service of My Stamps.
The consumer accepts that the right to use the personalised My Stamps as ordered from the Åland Post is limited to the consumer’s personal use and only for the normal purposes of stamps. The consumer must get a written consent of Åland Post for any other type of use of the stamps.
My Stamps are valid as postage for the consumer’s mail items from Åland. My Stamps are not to be considered a means of communication, as referred to in legislation on freedom of expression. The Åland Post has the right, in its sole discretion, to determine the consumer’s maximum quantity of stamps ordered.
The consumer does not have the right to use the trademark of My Stamps without prior written consent from the Åland Post. The consumer’s right of disposal of the ordered My Stamps applies to the right of using the image on My Stamps in unaltered form only.
The consumer accepts that the Åland Post has the right, through the means of its choosing to maintain catalogues of printed My Stamps for an unlimited period of time, inter alia or for the purposes of collection and exhibit. The Åland Post has the right to publish this catalogue. In the catalogues, images of printed My Stamps and information about their creators may be included. When placing an order, the consumer has the right to decline publication of the ordered My Stamps in the above-mentioned catalogues.
If the image uploaded by the consumer contains an image and/or name, the consumer must have the owner's consent to use the image/name in accordance with the terms and conditions of My Stamps as well as for the inclusion of the said image/name in the catalogue maintained by the Åland Post.
If the image uploaded by the consumer contains text in other than the Swedish language, the consumer must, at the request of the Åland Post, be ready to present an official Swedish translation made by a certified translator, after which the order may be processed.
The Åland Post may refuse to print, upload or transmit images or content on My Stamps, which the Åland Post determines to be illegal, inappropriate or objectionable. The consumer is aware that, in such cases, the Åland Post has the right to remove and destroy these image files.
The Åland Post may refuse to print My Stamps for material including the following (incomplete list): images and texts, which may constitute unlawful actions as noted in criminal or other law; images containing inappropriate motives, i.e. motives that are illegal, harmful, threatening, annoying, defamatory, immoral, violent, offensive, repulsive or indecent; images, figures and texts not worthy of a stamp; images and figures depicting governmental, public or similar symbols or distinctive features of postal services; images, figures or texts, which infringe on any patent, trademark, business secret, copyright or other exclusive rights, individuals’ right to their name, image or privacy; or images sent from an unknown or false address.
If the consumer wishes to create My Stamps using photos taken in photo studios, schools or by someone other than the consumer, the consumer must check with the photographer to confirm his or her right to use the image for My Stamps.
The Åland Post has the right by law to disclose above-mentioned material to the authorities, if the consumer transmits material to the Åland Post that may subject the partners of the Åland Post to civil or criminal liability, or if the consumer transmits material that violates the terms and conditions of the Åland Post, its partners or the directives and regulations of the competent authority. The consumer is responsible for the use of the image.
4 Product Information
Name: My Stamps.
Price: The consumer purchases a stamp with the denomination Europa or Världen. On deliveries to Finland , Åland Post collects VAT according to current Finnish VAT legislation. VAT is added to the invoice total.
Denomination: The denomination Europa is equivalent to the current priority postage for mail up to 20 g from Åland to any European destination. The denomination Världen is equivalent to the current priority postage for mail up to 20 g from Åland to any destination in the world.
Size of product: Mini-sheet of eight identical gummed stamps. The size of a stamp is 30.30 mm x 45.99 mm and the size of the image is 22.6 mm x 30 mm.
5 Ordering, Cancellation, Delivery and Payment
For the time being, consumers may only order My Stamps using the Åland Post’s online service at https://alandstamps.com/en.
The Åland Post has the right to change the price of My Stamps. Orders accepted by the Åland Post are delivered according to the terms and prices applicable on the day of order.
The consumer receives no separate order confirmation as mentioned in the Consumer Protection Act, chapter 6, section 14, as the information required is given in these terms and conditions as well as on the order form. The consumer is requested to print the completed order form as well as these terms and conditions. The Åland Post stores the consumer’s order form for one month, starting from the time of order, and the consumer may request a copy of the order form from the Åland Post during this period of time.
When My Stamps are produced, according to the consumer’s instructions and wishes, in agreement with the Consumer Protection Act, chapter 6, section 16, clause 3, the consumer does not own the right to cancel within 14 days of original order date as stipulated in the Consumer Protection Act, chapter 6, section 15.
When the Åland Post has accepted the order agreement, it cannot be terminated without justifiable reason. When the agreement is terminated for a justifiable reason, the Åland Post has the right to keep 50 % of the sum paid by the consumer as a handling charge depending on the status of the order at the time of termination.
All orders are subject to a delivery fee of from €4 to €15 depending on the chosen method of delivery. The minimum order of My Stamps is 1 set consisting of 2 gummed mini-sheets each holding 8 stamps, totalling 16 stamps.
The delivery time of the order varies depending on the country and delivery method, usually from 2 weeks up to 6-8 weeks. Please note that the processing time and any additional investigations after we receive the order are added.
The orders are delivered by post to the address provided by the consumer in the order form. Delivery is made in accordance with the Post’s general terms of delivery.
Payment can be made against invoice or by VISA and MasterCard. If the consumer has queries concerning the methods of payment, the consumer may contact Åland Post’s customer service before ordering.
The Åland Post has the right to change the methods of payment as well as the charges for handling of deliveries and payments. Orders accepted by the Åland Post are delivered according to the price quoted at the time of order.
If, referring to Part 3, the Åland Post declines to print the personalised My Stamps as ordered by the consumer, the Åland Post contacts the consumer within 30 days of original order date to negotiate the printing of a replacing product alternatively a refund.
6 Technical Requirements of Material
The consumer is identified by the information given by the consumer at the time of order. Material is not returned. The image material transmitted electronically is stored on the Åland Post’s server for two months after ordering, after which time it is destroyed.
Material requirements: all material must be delivered in a digital format. The maximum file size is 1.5 MB and the image format is .jpeg. The consumer is responsible for not transmitting material that causes disruption to the computer network and its service.
The required image aspect ratio meets the ratio of most digital cameras: 4:3 or 3:4. The resolution of the image must be 300 dpi. The Åland Post has the right to edit the size of the image to fit the frame of My Stamps.
The Åland Post uses the My Stamps-service in the way it best sees fit and uses subcontractors to provide the service.
The Åland Post has the right to make changes in the technical parts of the service or changes that affect the usage of the service.
The Åland Post does not supervise, and cannot supervise, transmissions of data over the Internet. Transmissions of data are to the most part delivered and supervised by independent Internet service providers. The actions of the third party may cause interruption or inability to access the online service. The Åland Post cannot guarantee that its services will be uninterrupted and makes no warranties of any kind. The Åland Post may, however, resume the printing of material that has been paid for in advance.
7 Intellectual Property Rights
Copyright and other intellectual property rights of the Åland Post’s products are owned by the Åland Post alternatively other companies part of the same group or their partners.
The Åland Post does not receive the intellectual property rights of material transmitted by the consumer; the rights remain the consumer’s. However, the Åland Post has the right to publish a catalogue as noted in Part 3. The consumer is responsible for all material transmitted to the Åland Post when placing an order.
The consumer is responsible for not transmitting material that may harm or cause damage to the Åland Post or any other person such as material containing any virus, data, files or programs designed to damage or cause defect, error, malfunction or corruption to programs, hardware, data etc. Material may not violate any person’s privacy, infringe on copyright or other intellectual property rights, conflict with good practices, laws or regulations of authorities.
The Åland Post has no obligation to check the intellectual property rights or other rights of material transmitted by the consumer.
The consumer assumes all liability for disputes, costs of trials or other expenses, claims or compensations that may arise from the transmitted material.
8 Information Collection and Use
When placing an order, the consumer must provide the Åland Post with the information necessary to deliver the order. The consumer must without delay inform the Åland Post of any changes in the information. The consumer is responsible for the information given to the Åland Post.
The Åland Post has no obligation to check the information given by the consumer. The consumer’s information may be processed in the Åland Post’s customer register in the way that is permitted and required according to the provisions of the Personal Data Act.
The consumer accepts that, if the production or delivery of image material is made by the Åland Post’s partner, the partner has the same right to process the personal details and order information as given to the Åland Post for the purpose of fulfilling the order.
9 Errors and Complaints
Immediately upon receipt of delivery, the consumer must acquaint himself with the product and examine it for possible visible errors or flaws and inform the Åland Post’s customer service of any such errors or flaws.
The Åland Post’s liability is limited to correcting such errors of the product which fall under the liability of the Åland Post or to delivering a flawless product.
The Åland Post is not liable for errors made by the consumer or caused by a third party independent of the Åland Post.
10 Indemnity
The statutes of the Consumer Protection Act on the responsibility of the seller are applied as regards to the responsibilities and liabilities of the Åland Post. The liability and responsibility of the Åland Post does not exceed what is laid down by Finnish legislation.
11 Amendments of the Terms
The Åland Post reserves the right to amend these terms and conditions. The consumer is informed of any changes in these terms at least one month before they come into force, either by a notice to the consumer or by posting a notice on the web pages of the Åland Post.
12 Other Terms and Conditions
These terms and conditions are governed by and construed in accordance with Finnish law. If any disputes between the Åland Post and the consumer cannot be solved through negotiation, the consumer may submit the dispute to the Consumer Complaints Board or alternatively to the District Court of the consumer’s place of residence or to the Åland District Court.
